By accessing or placing an order on this Site, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.

2. Definitions

  • Site / Website – the domain www.novioarts.com and its subdomains.
  • Content – all information available on the Site (text, images, videos, emails, digital materials).
  • Digital Products – personalized Christmas-themed video messages or other digital goods offered on the Site.
  • User / Client – any person accessing the Site or placing an order.
  • Order – the request submitted by the Client to purchase a digital product.
  • Transaction – a payment made for a digital product or service.
  • Contract – the legally binding distance contract concluded electronically upon order confirmation.

3. Use of the Site

By accessing the Site, the User agrees to:

  • provide accurate and complete information;
  • not use the Site for illegal or fraudulent activities;
  • check these Terms periodically for updates.

The Company reserves the right to modify the Site's structure, design, or content without prior notice.

4. Formation of the Contract

A Contract is considered concluded when:

  • The Client completes the checkout process and submits the Order.

5. Description of Services

The Company provides personalized video content featuring Christmas themes. Videos are generated using pre-recorded footage, licensed audio, and personalization details submitted by the Client (such as name, age, photo, or other attributes).

The Client confirms they are legally entitled to provide the personal data and photographs used for creating the video.

5.1 AI Technology

The videos provided may be fully or partially generated using artificial intelligence technologies, which can occasionally result in minor visual or audio imperfections. These materials are intended solely for entertainment purposes.

The character 'Santa Claus,' along with any similar characters, is a fictional representation.

6. Ordering Process

6.1 Placing an Order

To place an order, the Client must:

  • complete the order form with the required details;
  • upload photos and personalization information (if applicable);
  • accept these Terms;
  • complete the online payment.

6.2 Confirmation

The Contract becomes effective upon payment.

6.3 Cancellation

Video production begins after payment. Once the personalization process has started, cancellations and refunds are not possible.

7. Prices, Payment, and Invoicing

Prices are displayed in USD (or the equivalent converted currency) and don't include applicable taxes.

Payment is made exclusively online via card through the approved payment processor.

Invoices are issued electronically based on the billing information provided by the Client. The Client is responsible for ensuring these details are correct.

8. Delivery of Digital Products

Personalized videos are delivered digitally via:

  • direct email; and/or
  • a download link.

Delivery Time: Official delivery time: 4 hours. In exceptional cases (peak season or technical issues), delivery may take longer. Clients will be notified if delays occur.

Download Link Validity: The download link is valid for 15 days. It is the Client's responsibility to download and securely store the video within this timeframe.

9. Refunds and Return Policy

Because products are digital and personalized, once delivered or accessed, they cannot be returned, according to EU and international digital-goods standards.

A refund may be granted only if:

  • the delivered product contains a clear technical error attributable to the Company;
  • the Client reports the issue within 48 hours from delivery.

If the issue is validated, the Company may:

  • re-deliver a corrected version; or
  • issue a full refund if correction is not possible.

10. Intellectual Property Rights

All content on the Site, including the final personalized videos, templates, scripts, audio, visual assets, and branding elements, is the exclusive property of the Company.

The Client receives a non-exclusive personal-use license to view and share the video privately.

The Client may not:

  • resell the video;
  • modify or edit it for commercial purposes;
  • distribute it publicly or commercially.

11. Anti-Fraud Policy

The Company will never request sensitive data (passwords, complete card numbers, banking access credentials).

Suspicious or fraudulent activities (including unauthorized access, identity impersonation, hacking attempts) will result in immediate access restriction and may be reported to authorities.

12. Limitation of Liability

The Company is not liable for:

  • delays caused by third-party providers or force majeure;
  • issues arising from incorrect data provided by the Client;
  • the Client's failure to download the video within the available time.

Maximum liability is limited to the amount paid by the Client for the affected order.

13. Protection of Personal Data

Personal data is processed in accordance with our Privacy Policy, which is part of these Terms.

14. International Users & Governing Law

These Terms are governed by Romanian law.

If you are a consumer residing outside Romania (including the United States), you may also benefit from the mandatory consumer protection rights applicable in your country.

Any dispute that cannot be resolved amicably shall be brought before the competent Romanian courts.

15. Force Majeure

Neither party is liable for failure to perform obligations due to events outside reasonable control (natural disasters, utility outages, war, strikes, internet failures, etc.).

16. Changes to These Terms

The Company may update these Terms at any time. The version applicable to an order is the one in force at the time the Client places the order.
